Hỏi: A được giao xây dựng một phần mềm ứng dụng thuộc lĩnh vực quản lý của cơ quan mình (là một cơ quan nhà nước). Trong đó, cơ quan cấp kinh phí từ ngân sách nhà nước cấp hàng năm để A xây dựng với mục đích phục vụ cho công việc của toàn cơ quan. Hỏi, phần mềm sau khi được đưa vào ứng dụng có thuộc tài sản công của cơ quan nơi A làm việc không?

Theo quy định tại Điều 20 Luật quản lý, sử dụng tài sản công thì quyền sở hữu trí tuệ, phần mềm ứng dụng, cơ sở dữ liệu là tài sản công tại cơ quan, tổ chức, đơn vị.

Do đó, phần mềm ứng dụng do A xây dựng từ nguồn kinh phí ngân sách được cơ quan nơi A làm việc cấp thuộc tài sản công của cơ quan này.
